Crypto TaxTax year 2025

Luxembourg cryptocurrency tax guide

Luxembourg, per Circular LIR 14/5 of 26 July 2018, taxes individual crypto gains realized within six months of acquisition as speculative miscellaneous income at progressive personal income tax rates, while gains realized after a holding period longer than six months are, in principle, tax-exempt (subject to a EUR 500 aggregate annual exemption for gains below that threshold regardless of holding period).

What this guide covers

This guide covers Luxembourg's individual crypto tax rules for 2025 under Circular LIR 14/5. impotsdirects.public.lu itself wasn't directly fetched. This is educational information, not individualized tax advice.

Tax treatment of cryptocurrency

How long you hold your crypto before selling decides whether Luxembourg taxes the gain. Under Circular LIR 14/5 (26 July 2018), the ACD applies a six-month speculative-period test to individual crypto gains. Gains realized within six months of acquisition are treated as speculative miscellaneous income, taxed on a net basis at Luxembourg's progressive personal income tax rates. Gains realized after a holding period exceeding six months are, in principle, tax-exempt. A EUR 500 aggregate annual exemption applies to gains that don't exceed that threshold, regardless of holding period. Frequent trading, use of borrowed capital, or trading for third parties can push activity into business income instead, taxed under Luxembourg's ordinary business-income rules following a fact-specific analysis.

Common taxable events

  • Selling or exchanging crypto held six months or less, for a gain exceeding the EUR 500 exemption — taxed as speculative miscellaneous income at progressive rates.
  • Staking, mining, and similar income — generally taxable upon receipt at market value.
  • Activity characterized as a business — frequent trading, leverage, trading for others — taxed under ordinary business-income rules instead.

Potentially non-taxable events

  • Selling or exchanging crypto held longer than six months — in principle tax-exempt.
  • Gains not exceeding the EUR 500 aggregate annual exemption threshold — exempt regardless of holding period.
  • Simply buying and holding crypto isn't a taxable event.

Tax rates and thresholds

Speculative gains — held six months or less, exceeding EUR 500 aggregate — are taxed at Luxembourg's progressive personal income tax rates, which this guide doesn't reproduce in full. Gains held longer than six months, or not exceeding the EUR 500 threshold, are exempt.

Cost basis and calculation

Speculative gains are taxed on a net basis — proceeds minus acquisition cost. This guide doesn't independently confirm a mandated cost-basis identification method.

Reporting and compliance

  • Taxable speculative gains and business income go on your annual income tax return.

Residency and cross-border issues

Your Luxembourg tax residency generally governs whether your worldwide crypto gains fall within this regime. Cross-border workers may face additional considerations this guide doesn't detail.

Example

This example is hypothetical, for illustration only. Sophie buys crypto and sells it 4 months later for a €2,000 gain. Because the holding period is under six months and the gain exceeds €500, it's taxed as speculative miscellaneous income at her applicable progressive rate. Had Sophie instead held for 8 months before selling, the same gain would be exempt under the six-month rule.

Limitations and review information

Tax year covered: 2025. Last verified: October 11, 2026. Known gap: impotsdirects.public.lu wasn't directly fetched, and Circular LIR 14/5's full text wasn't independently re-read, though its exact number, date, and core holdings are consistently corroborated across multiple independent secondary legal sources. This guide doesn't confirm whether any more recent circular has updated this 2018 guidance. This is educational information only, not individualized tax advice — confirm current specifics directly with the ACD or a qualified Luxembourg tax professional.
