Tax Haven
A jurisdiction offering notably low or no tax on certain income or gains, commonly combined with limited transparency, used by some to minimize tax liability.
A tax haven is a jurisdiction offering notably low or zero tax rates on certain types of income or gains, often combined with limited financial transparency or reporting requirements, used by some individuals and businesses specifically to reduce their overall tax liability.
Simply holding crypto or using an exchange based in a jurisdiction commonly described as a tax haven doesn't by itself change a person's own tax residency or tax obligations — obligations generally still depend on the taxpayer's own residency and the specific rules of their home jurisdiction, including rules (see Kaavon's "Controlled Foreign Corporation Rules" glossary definition) specifically designed to prevent this kind of avoidance.
Examples
- Using an exchange headquartered in a low-tax jurisdiction doesn't itself change a user's own personal tax residency or reporting obligations.
- Many jurisdictions have specific anti-avoidance rules, including Controlled Foreign Corporation rules, designed to limit the tax benefit of simply routing income through a tax haven.
